Welcome to Option Poll .US (“we,” “our,” or “us”). By accessing or using this website or our associated mobile applications (collectively, the “Service”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree with these Terms, you must not use the Service.

1. Eligibility and U.S.-Only Participation

The Service is intended solely for use by persons physically located within the United States and its territories. Any use of proxy, VPN, or other location-masking technologies to circumvent this restriction is strictly prohibited. We reserve the right to suspend or permanently terminate any account, remove associated data, and deny further access to users attempting to subvert our non-U.S. or proxy-related enforcement measures. Paid subscribers found in violation of this policy are not eligible for refunds.

2. Description of Service

Option Poll .US provides online tools for creating, sharing, and participating in opinion polls and discussion features. Some portions of the Service may be available at no charge, while other features or enhancements may require payment. We may introduce or modify pricing, features, or access levels at any time with reasonable notice.

3. Accounts and Security

Users may be required to register for an account to access certain features. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. We reserve the right to refuse service, terminate accounts, or remove or edit content at our sole discretion.

4. Paid Services and Refund Policy

Paid plans provide enhanced capabilities beyond the free Service. Fees are due at the time of purchase and are non-refundable except where required by applicable law. If your account is terminated for violating these Terms—including use of VPNs or non-U.S. access—you forfeit any right to refund or credit.

5. Acceptable Use

You agree not to misuse the Service, including but not limited to: (a) attempting to interfere with the Service’s functionality; (b) using bots or scripts to manipulate voting results; (c) submitting unlawful, infringing, or harmful content; or (d) engaging in activity that violates applicable U.S. laws or regulations. We may monitor, restrict, or remove content that violates these standards.

6. Intellectual Property

All software, graphics, text, design elements, and other materials available through the Service are owned or licensed by Option Poll .US and are protected by U.S. and international copyright and trademark laws. Users retain ownership of their original poll questions, comments, and other contributed content, but grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and promote such content within the Service.

7. Disclaimer of Warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

8. Limitation of Liability

IN NO EVENT SHALL OPTION POLL .US, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO ANY USER SHALL NOT EXCEED THE AMOUNT PAID BY THAT USER (IF ANY) DURING THE SIX MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless Option Poll .US and its affiliates, officers, employees, and agents from any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Service.

10. Modification and Termination

We may modify these Terms or discontinue any portion of the Service at any time. Continued use of the Service after updates are posted constitutes acceptance of the revised Terms.

11. Governing Law and Venue

These Terms are governed by the laws of the United States and the Commonwealth of Pennsylvania, without regard to conflict of laws principles. Any dispute shall be brought exclusively in the federal or state courts located within Somerset County, Pennsylvania.
